Rental Caps - how do they work?
Homeowner Associations may or may not have a rental cap, or rental restriction in place. The governing documents determine whether the HOA has the ability and authority to create a rental policy to either restrict or allow rentals of individual units.
Some Declarations specifically state whether rentals are allowed and if there is a process a unit owner must follow to rent out their unit. A Declaration can be amended to change or create a rental policy which would require approval from the homeowners.
HOAs generally have the latitude to establish policies, procedures, rules and regulations regarding how rentals are managed and tracked within the association.
